Freedom of Information Requests

 

The City of North Bay DOES NOT process Freedom of Information Requests for the North Bay Police Service or the Ontario Provincial Police.  Please forward ALL requests for information associated with an outside agency directly with that agency. Below is a list of local agencies that have designated persons who manage requests for records in their custody and control:

The Freedom of Information (FOI) process is a part of the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA). This legal process was designed to make sure that all requests for access are treated fairly and objectively. MFIPPA sets out that information should be made available to the public, and that certain types of records such as personal privacy of others, trade secrets, lawyer-client privilege, etc. must be protected.

Before filing your request you should contact the City Clerk or Deputy City Clerk to see if a request is necessary.

The Information and Privacy Commissioner of Ontario (IPC) is a neutral third party who, upon appeal, review records and the law to determine whether an access decision by the City will be upheld, or, determine the appropriate decision.

Requesting Information from the City

  • FOI Requests are not started without receipt of the $5 fee, and, if applicable, once the request has been clarified

  • In accordance with MFIPPA, exclusions and exemptions may apply - view the Access or Correction Request Form for more details
  • Except where an extension is necessary, all requests will be completed within 30 calendar days from date of receipt of payment

Ontario Provincial Police

All requests for OPP records go through the Freedom of Information (FOI) process. Please visit https://www.ontario.ca/page/how-make-freedom-information-request to obtain information on the request process and about the Act.

Law enforcement agencies such as the North Bay Police Service, Ontario Provincial Police, the Children Aid Society, etc. may request information from the City to aid in an investigation.

Records routinely available to the public are also available to any law enforcement agency subject to any relevant conditions. Records containing personal information may also be disclosed to a law enforcement agency. 

CCTV Video Requests

Only law enforcement agencies are able to request this footage. Any type of request for video surveillance are to be forwarded to the City Clerk and Deputy City Clerk.

Internally, the City Clerk's Office organize the coordination of video review between the internal staff and the requesting agency to ensure that the privacy of individuals is protected. 

Once the footage is reviewed by the City Clerk's Office, the information is then released to the requesting agency.

Note: Where an agency does not have the necessary technology in place to protect the personal information of individuals, any requests involving personal, confidential or third party information will require a subpoena or court order prior to release.

There are a number of reasons a municipality may collect personal information including:

  • To establish, administer and maintain billing, payment (eg. taxes) and other service information
  • To process requests for services or information (eg. Planning applications, permits and licences)
  • To communicate with you about services, information requests or applications
  • To communicate any changes or disruptions in services
